work what happens next help

Hi everyone,

i work part time for a company in my contract they can move me around.I have had alot of issues at work,they told me a couple of months ago they was going to move me further away to work,i refused to go as i have ms and suffer from extreme fatigue.They were adament that i was going to move only after writing backwards and forwards they are sending me for a assessment with a doctor.If they haven’t got a job for me like they are saying does anyone know what happens.

Hi, I would`ve thought you should be on the sick, before they deem you unfit for the job you are employed to do only.

I`m a tad unsure of your meaning…did you mean YOU wrote backwards and forwards and this made them think you are unfit for the job you currently do? Sorry for sounding thick here!

I was on the sick for 8 months, before they asked me if I wanted to leave then, as they had no other jobs suitable for me, or wait a further 4 months and finish on ill health.

I decided to go then. I did get a good package.

I think you will need specialist help with this one.

As your contract stipulates that the comp can move you about they are not making changes. It is you who wants a change – to stay put. All employers have an obligation to make “reasonable adjustments” to working practices to allow people with disabilities to continue in the job. It may be that they will argue that your desire not to move is not ”reasonable” and they cannot accede to it.

I think you will have to raise a grievance about the proposed changes. (But perhaps you have already done this with the letters going backward and forward)

My advice would be to contact your nearest CAB. As you are a part time employee some of your rights of appeal are limited so it would be best to head this off at the pass if you can.

If you are feeling that you actually want to finish work then Poll is right – you need to go off sick first.

I want to continue to work,but it is to tiring for me to travel further away.I don’t know what package i would get as i only work part time i have been there for twelve years nearly.I have had load of problems with them.Did you work full time,i just really don’t know what to do,cause if they retire me i won’t be able to work anymore will i?And also i don’t think the doctor will say i am to ill to work.Have you any advise as i had a relapse at the beginning of november,and am due to go back to work on monday.I feel all the stress at work is doing me no good.

Any advise poll would be appreciated.

I think you need specialist advice with this one.

As your contract stipulates your employer being able to move you around it is you that is asking for a change not them. However all employers are obligated to make reasonable adjustments to enable a disabled person to continue working. They may say that your desire to stay in one place is not ”reasonable” and that they cannot accede to it. If that is the case and they cannot offer you alternative employment they will want to terminate your contract.

What happens next depends on your pension situation. Poll worked (I think) for a superan employer and was able to claim her pension early. This may not be available to you.

As a part time worker your rights of appeal are significantly less so this will have to be done by negotiation. I strongly advise that you seek help from CAB who will be able to unravel your rights.
