Just got my tribunal date for my appeal it’s been 16 months since I first applied. I’ve got help from citizens addvice and he will be with me on the day,he’s had good look at my case and thinks I have a good chance of winning Fingers crossed. Neil
Very good luck with your appeal. If the DWP ring you and offer a settlement at the last minute and it’s acceptable, make sure that they email their offer to you before you agree as they have been known to be a tad norty at times. IE., they cancel the appeal then the letter you receive with new award is not as agreed. If this does happen get straight on to the tribunal service and tell them what has happened so your appeal can be reinstated.

If I win my tribunal do they back date any award that I may get if so how far back do they go. Neil

As far as I know the back dating goes to when the decision was made to turn you down for PIP. That’s if it was a transfer from DLA to PIP. I’m not 100% sure but think if it’s a complete new claim and no transfer then it’s from day one of applying for PIP.
It’s a new claim so it may be from the date I first applied.

Neil, I will never forget the day I went to ‘tribunal’ (about 16 years ago?). I remember the anger I felt when I was turned down, as if I was a liar! I was advised by fellow claimants (who were also attending for whatever reason…), just before the hearing, to walk in a certain way etc… I just couldn’t, I am who I am! Afterwards, while sitting in my car going back to my temp job, I almost felt completely paralized, possibly caused by the stress! As I said, I was turned down first time, after which I called in the help of ‘my’ neurologist, Mr Martin, and their decision was reversed…
Therefore, ask the back up of your neuro, you’re not a beggar, and your future is very uncertain (as it was in my case)… I kept on working afterwards for a few more years (as a carer myself!, an experienced one as my daughter is disabled!), till the moment one of my clients claimed (in good nature btw) that I was more disabled than he was…
Good luck, and wow, you will have the assistance of the Citizens Advice Bureau, what a luxury! (I mean this in a positive way!) but, do not forget any kind of back up from your neurologist…, remember, you are there for a valid reason! - Jos.

It is not daunting at all, WHEN you win the appeal you get your money backdated, which is an additional pick me up.

Thanks for all the good wishes you can only turn up and tell the truth ,I’ve got back up letters from my physio and nurses so ok there . Hopefully it won’t be like the one to one I had a the beginning I don’t think she had any idea what someone with ms has to live with on a day to day basis. Neil
Good news I’ve had my pips tribunal today and have been awarded daily living standard rate for 4 years. Unable to get anything for mobility but the judge said he thanked me for being honest about my mobility problems and that at the moment I didn’t have enough points ( 4 ) to qualify, but all in all very happy with the result.
