PIP TRIBUNAL

Just to let you all know that i went to the tribunal for my PIP payment on thursday and won my appeal the judge was very unhappy at having to deal with this case as it was clear from the medical evidence i had submitted that it should never got as far as him and took great delight in telling the man from DWP that the person that took the orignal decision should go for some serious retraining and perhaps the assesment from ATOS could have been carried out by someone that knew about MS and not just a physio . I sort of feel happy but it feels in my mind that its now offical that i am not suddenly going to wake up tomorrow and its all been a bad dream, so need to try and except how things are and move on. I’ve recently applied for pip due to my recent relapse (2weeks ago) which as caused me to loose strength in my arm and both of my legs causing me to be in a wheel chair. I rang DWP and requested a pip package to fill in and did the questions over the phone and received my pip forms but then I received a letter saying I’m eligible for more money it then goes to saying about claiming carers allowance and I’m eligible but I’ve not had an assessment does this mean I’ve automatically been accepted for higher rate pip or have a good chance to be allowed pip??

That’s a great decision, I’m really pleased for you. It’s just a shame that the useless DWP put you through so much stress in the first place and wasted money in the hope that you would go away quietly when the evidence was there all along! Grrrr! Anyway, now you can get on with enjoying life and put the whole experience behind you Tracey x

Hi Katy , Brilliant news , I hope you can relax now. So long as you keep your own copies of all your medical files regarding treatments, medical diary, etc, and have a good Medical team behind you , you will be fine. Its just a shame ATOS Doctors or whoever, have become experts at twisting everything you say or do at the medical assessment, to make sure you dont get the points or the benefits you deserve. I read an article late last year, and apparently ( because of the appauling way they have treated people ) ATOs are now being advised/helped by a team of experts from outside, on how to carry out the medicals more effectively and fairly. Also just last month, ATOS have only now been given complete access to our medical files. It was always known that they never bothered to contact our Gps or Specialists for essential back up. Hopefully now it will all start to change… I loved the fact your judge was annoyed with ATOS. ITs not often you hear judges speak their minds. That must have cheered you up. Ps .
