Early Retirement update

Hiya

After 8 months of being off sick my LA is going to retire me early on the grounds of ill health due to MS!

I knew I was lucky to be entitled to 12 weeks money in lieu of notice but expected it to be paid in one lump sum however they are going to pay it over June, July and August.

I’m puzzled how they can end my contract at end May but then keep me on the payroll till mid August!

Does anyone know if this is how it happens?

I cannot offer any advice over the payment in lieu of notice; have you spoken to your union rep about it?

Have you been assessed by an independent Occupational Health doctor in relation to your LG pension scheme, assuming you belong to it, in order to determine the award that you are entitled to? I am sure that you are aware of the different tiers. I do not know your age and circumstances, or whether you have already completed the process.

I have been through this assessment procedure myself when I retired last year and I will gladly offer any help I can.

Yes the Independent Occupational Health Doctor determined that I be retired through Tier 1 as am unlikely to work again.

But I haven’t yet heard re: my pension although I am told they will be in touch anytime.

I assume that my pension cannot start until the LA stop paying me?

It sounds like you need to ask your LAs payroll / HR department. As you say, you may not get your pension paid until you stop being salaried by the council.

My first thought on reading your post was that you need to be asking some serious questions as soon as possible. e.g. how much pension will you get each month, is the pension enhanced, when will it start etc ?

You also need to make sure you’re getting the best deal possible.

Are you in a union - they will advise.

Don’t assume large organisations always do the ‘right’ thing by their employees.

I retired through ill health from the NHS in 2012.

They had to terminate my employment first of all because I had to be terminated to show that I couldn’t carry out my duties even though adaptations had been made.

They terminated my employment in May 2012 and I received the 3 month notice sum in one lump sum.

I then heard from Pension Dept with my ill health pension amount. I did ask for an estimated amount at first should I be accepted for ill health.

I hope you have asked for an estimate from your Pension Dept as you are entitled to ask for this.

Hope this has helped and I hope you hear from them soon as it is a worrying time, especially as they have to terminate your employment before you actually get to know if you have been accepted for ill health retirement. It was all very straightforward for me in the end and I hope it is for you.

I have to say that my experience of asking my Union’s advice was hopeless.

Human Resources have told me this afternoon said I should hear from Pensions next week!

But I’m still not sure why they’re paying my 12 weeks notice money over 3 months!

Oh and like you Shazzie I’ve not found my Union helpful!

I retired on ill heath from a council.

You are entitled to 12 weeks in lieu of notice.

They can keep you employed or finish you and pay you up.

If you get the 12 weeks as pay in lieu of notice it should be tax free.

Not sure about tax if they keep you working.
