No hope... No hope...

Hello Everyone, I am about to explode!

I got a letter from the Tribunal service today, They say in it stamped 29th Oct 12 that I have no grounds to be put on the support group, That by govermental law there will be no need for a hearing so I don’t even get a say.

This is because when they saw me on Dec 11 my personal care was good (LIE!)

Also I can drive an car (Automatic).

Oh yes around Oct last year I did a little volentere work as I have really bad depression. Big mistake doing 5 hours every 2 weeks, but I did check and even people in the support group are allowed to do this kind of work…

So On those grounds, I can’t have my say, they have ignored my Doc letter that reads I have a severe level of the disabilty and should reframe from work to avoid further deteriation.

My Neuros letter says This woman can never keep down a part time or full time job.

So yes they read all that before they made there minds up and now I don’t even get a say…

Oh and I am on mid rate DLA care seems that will go out the window next year by their ratings!

I can never seem to catch a break… I was born leg first from my mum so I lacked loads of oxygen which never helps, born blind, with epilepsy! So never been able to go to school as I was too sick to attend.

I am on the edge of my seat at the mo as I have had enough and I have attempted suicide in the past but they dont even take that seriousely!

So my god I hope all those drugs dealers and so on are happy with there £72 a week JSA because they really need it… As for the incomebase if u live with ure parents! u know what the only reason I have been living is because my Parents help me as much as they can or tho they cant afford to. My dad is 67 and has always worked and cant ever stop as he losted his pention a few years ago to depts.

My partner does not have enough money to help me and why I have to give him £500 of my money a month!

Best yet I am having to cancel my wedding as I can’t see no way of living, will loose my £500 deposit but I guess thats better then anymore.

Oh love! I can well understand your anger and frustration with the authorities.

But surely there is a way of appealing further. Your docs and neuros letters speak the truth. You need legal advice.

The C A B wrote numbers of letters to them saying they r in the wrong but they are not listerning to them even :frowning:

Also how can they get away with lying? They say that I can walk but first meeting I was in a wheelchair and they made me get up without the help of my friend (they would not alow help) I walked a few steps with walking stick and fell over… 2 days after that I ended up in hospital for a relapse.

Saw them again 4 months after that with walking stick and friend and partner for support.

How is that able to walk!?!

As for personal care I need help with alot of personal stuff and I cant believe they say my is great! :S

This is diabolical, it should be headline news in the papers, Trouble is things like this are not publicised and they get away with murder.

Have you been onto the MS soc,? I believe they have a legal rep who may offer some help.

Don`t let it go, I know that when you are feeling poorly and frustrated its hard to fight back, but this is what they are hoping for.

How dare they refuse you leave to appeal.

And yes at the mo I am in no fit state of fighting as I have had this relapse which has been going on for 3 weeks now, no steroids are helping and I am numb from the cheast downwards, everyday more of my body is getting numb with no recovery what so ever…

Hi Hon, what absolutely dreadful news. I’m disgusted.

Ok, I have been doing a bit of research on Benefits and Work website to see what you can do.

Firstly, when you received the Pre-Hearing Enquiry Form the first 2 questions would have been:

1/ If you do not want to continue with your appeal, please tick this box

2/ Do you want to have a hearing where you and your representative, if you have one, can meet the tribunal to put your case?

Do you remember this? Did you tick the box for Question 2 asking for a hearing?

According to Benefits and Work, paper hearings (which you have had) stand little chance of success.

If you ticked the box for Question 2 (saying you want a hearing) they have to have a hearing. They cannot refuse it.

Next, if you didn’t tick the box (in other words didn’t ask for a hearing) you can still go to something called the Upper Tribunal. This is essentially a court case (but that’s just another way of saying ‘tribunal’). As I understand it you can still do this but you have to put in the request within one month of receiving the letter saying that your appeal has failed.

If you go this route I strongly advise you to join Benefits and Work website and follow the guide. (£19 something a year)

But PLEASE don’t let all the above info confuse you and upset you even more than you are already. If you can’t make head nor tail of it at the moment, copy and paste it and save it and look at it in a few days when you’re feeling calmer.

My heart goes out to you hon. It’s bloody criminal. Yes your story should be in the newspapers!

Yes I had all those replys to tick boxes to say I want to go on for appeal and 2 months after all that I get this answer back that there are no grounds in law that I belong in the support group and my will stay as WRAG

I am going back to the C A B on Tuesday as I see it too unfair that they will not let me have my say and only go by the infomation the Job centre woman made when she saw me in Dec 11 or tho looking at it now it is all lies

If you asked for the hearing they have to give you a hearing. This is their error.

Have you a copy of the form showing that you ticked the box?

You need to write to them and say that you ticked the box… and include your copy (make sure you make another copy of it) and say that you want to have the hearing before a tribunal like you asked for.

If you have no copy, write and ask them to look at the form again and see that you ticked the box for Question 2, and say that you want the tribunal hearing that you asked for.

As long as you ticked that box they have to give you a hearing.

I am sure that the C A B might of kepted a copy so figers crossed! They seem to always have loads of details way be4 anyone else.

Great. Ok… job number 1. Phone CAB first thing Monday morning and make an appointment with them. Your case might still be open which might make it quicker. Explain on the phone how urgent the situation is.

When you say that CAB has already told them they are in the wrong, what was that about? If you got the letter this morning I’m assuming that CAB don’t know that you have been refused a hearing?

Just explain to me why CAB have already told them they are in the wrong… just trying to get my head around it.

OMG can’t believe what I’m reading this is wrong wrong wrong. Get your local MP involved too it’s amazing what sway they have on these things. Thinking of you & dreading my reply for my appeal. xx

Ok Well the CAB say they are wrong because of the neuro letter that says I must be precluded from full time work and park time as I can never do it.

They are 100% right as 5 years after I Had MS I got fired from 3 jobs within a year after from returning from relapses, and used a rubbish excuse like we dont need u no more… but why just after a relapse…

Oh and my MP is not good at all I tried him a few years ago and he just looked at me one day and very next day I got a letter saying theres nothing he can do, the fact he is a conservative may be why!

Ok… thanks… I understand now. The CAB contacted them to say that you should have been put in the support group.

So call CAB Monday morning and tell them that they have denied you the hearing at a tribunal. Explain about ticking the box on Question 2 saying that you want to go to the tribunal.

That is the bit that DWP have got wrong. If you ticked that box they have to allow you a hearing. CAB will be able to write to them saying the box was ticked… and as you say, they should have a copy.

Best of luck hon. Do let me know what CAB say. Try not to worry too much… from what I understand if you have ticked that box they have made a mistake by giving you a ‘paper hearing’.

Ah no I def ticked the box for sure, I will go through my papers tonight because I somewhat feel like I may have a copy, but my memory is so bad with certain things…

I got a CAB appointment on Tuesday to fill out a form to be reasseased which makes no sence to them what so ever while going through an appeal. So basically doing the point scoring thing again, it makes no sence but I am guessing because my last test was Dec 11 that they may do it yearly.

Oh the tick wa sthere as my CAB is my rep and said he would rep me at the CAB for starters
