GOOD NEWS ! - GP Mistake with Factual Report for Disability Living Allowance form

I had earlier this month lost my DLA benefit because my GP completed Factual Report for Disability Living Allowance with the completely wrong information, even saying I dont take any medication for my MS, and have never had a relapse.

It’s been a tough 10 days, but my Husband was called by a Decision Maker Team Leader at the DLA who said they have looked at the evidence and have reversed the decision with immediate affect, no tribunal needed, and apologised.

It can be done !

My husband wrote a strongly worded yet polite letter to the surgery, with demands, which all were met. We got an apology from the GP, and a new ‘Factual Report for Disability Living Allowance’ form was couriered to the DLA.

My husband then called the DLA on Tuesday and made sure he got through to the a manager in the ‘Decision Makers Team’. I don’t know what he said, he won’t say, but we got a call today to say sorry, Benefit back in place, not to worry.

He did say he asked about ATOS, and was told I will never be troubled by them, as you have MS and thats progressive.

Excellent…What brilliant news for you,and thank you for sharing. It’ll be interesting to see the expression on the GP’s face the next time you see him.'Praps he’ll get you some physio in the Maldives as his way of saying sorry.

Nice to know that ATOS will be leaving you alone,

Bravo,

Wb

Thats brilliant news and I am so glad you shared this. Just goes to show down lie down and let people walk all over you. Brilliant

So happy you managed to get this sorted. Shame on your GP for putting you through that.

Hi That’s great news. Are they suggesting that when PIP starts you will not need to attend the ATOS / Capita assessment as PIP does not look at the name of the disability but more at the persons abilities. This case shows our reliance on accurate GP / Specialist reports. S4ar

Well done really pleased I can appreciate the torment you’ve gone through but then to loose it through the total incompetence of a GP must of been awful and doesn’t instill much trust in them does it. I hope what they said about ATOS is true, we need a break.
