Hi what did they offer you?

I know you have a motability car but is it the end of the world if you loose it? Could your family not get together and find you a nice little run around you obviously dont need a big car just one to get to post office and back for your little job. You can pick up some nice little Kas, or fiestas for reasonable money, and the tax cost is very low £20 a year. There are a ton of them out there.

what did you get offered, i thought you had standard mobility.

If you do you can get 50percent off your car tax. You would have just over 90.00 a month in your pocket where as you were using the enhanced to pay for your car. so you can still afford the running costs.

Now then this is temporary as you know you can claim again if things change and believe me it will in 3 years.

Why get sick and fed up over a car?

You write in such a way I would be worried you shouldn’t be driving. I stopped because my cognitive issues got worse and i developed TEA (transient epileptic amnesia), and the day i felt scared on the road driving was the day i stopped, so you have to balance all this out. Is it worth going through all the upset. It sounds like you have a pretty good support network with your family. Having mild dementia diagnosed for example (low cognitive function) it is a legal requirement to inform DVLA and be agreed by a doctor they are able to drive. I worry you are talking yourself out of a car licence.

You lost by a few points in a way that’s good if you think about it because you are still perceived as being in a better place. I wish i could still drive but i know it is too dangerous for me and others.

Hold on to all your faculties and mobility for as long as you can hun.

things have a way of sorting themselves out. You have a lovely family, a little job you do; can still drive that for me is HUGE. Its what you have that is important and I am sure you can sort it out to a satisfactory conclusion without causing yourself huge stress.

I had a primera automatic i bought myself it cost me 5,000 i had it 8 years (before I got sick) and it never let me down i loved that car and I never once thought when i got sick i would loose it because i couldn’t drive safe anymore. I lost my job and my independence, i would do anything to have just a little of that back.

Dont be in a rush to prove your more disabled for 37.00. You know you are, you know how you feel, but hold on to it for as long as you can so you can still enjoy some life. xxxxxx

I hope i havent been too forward in my answer and would not wish to upset you in anyway, I am trying to show you that yes its hard, yes its unfair, but you can find a way around this for now without causing yourself more worry and upset its a temporary fix because you and i both know things will change then you can try again. The DVLA know, I am on a restricted - 3 year licence.

I only go local, no more than 10 miles on my own and in a rural location.

did you tell the powers that be that hun? all these things are there as the pieces of a puzzle. every little bit of evidence helps.

Update:

Motability were brilliant, all my concerns have gone from that perspective. I spoke to a chap who said there is no way they would even think about taking a car off someone until all is settled, so any appeals/tribunals etc pending are not a problem to them. They extended all my stuff by 2 months, and then they have requested I call the same chap back every 4 weeks to tell them any progress.

If i was to lose my appeal (i am convinced I won’t) they would allow plenty of time for me to resolve the car position if needed.

I am a little relieved to say the least.

Charlie so glad you rang them i did think that was the case, as my friends husband had to wait SIX months for his tribunial and they never took his car off him.

Now you can chill out a bit.

Crazy Chick I would like to say thank you, I got up yesterday and read your reply and have felt so much better, I can see a glimmer of hope.

I have not told PIP that I am on a restricted driving licence and have had to renew it every 3 years.

I scored 0 points out of 12, I only need 2 points to keep my car so hopefully that may just do it.

Charlie I am so pleased for you :slight_smile: just knowing that you are able to keep your car through an appeal makes you feel better.

The letter says I can keep my car until 9th April, I haven’t rang Motability up yet, didn’t want to face up to it but I will now.

Has been a while since I updated you all on the PIP situation.

No surprises, still waiting for my tribunal date.

Just spoken to the tribunal people, the average wait for a date in my area is now 36 weeks. It did make me chuckle, 4 weeks ago the wait was 26 weeks so I questioned how the average could increase by 10 weeks, and prior to that the average was falling! Simon the call handler really couldn’t help or explain.

I scanned and emailed my annual review with my neuro to them to add to the case. The neurologists clearly states EDSS score 6.5 - 7.00. he discussed my wheelchair, and he states clearly that I could not walk the 20 meters to the consultation room. If that doesn’t get them thinking I really don’t know what else I can provide. If I don’t get the extra 2 points needed I might just give up!

Well another letter yesterday. I have a date!!! May 14th. So that will be exactly 36 weeks since they had the tribunal request, shocking. Hopefully a light at the end of the tunnel and someone, or lets hope 3 people see the obvious DWP incompetence and this can all be laid tp rest for a while. Charlie

I’ll keep my fingers crossed and maybe cast a little spell that the tribunal panel are people of good sense and judgement.

Then again, you may not need luck or magic as about 72% of PIP tribunals are found in the claimants favour.

Government is so dysfunctional.

Tribunal result, enhanced living, enhanced mobility, and it is “inappropriate to fix a term” for either component.

I got there in the end!

HOORAH, finally. I wish you could sue them for all the stress you have been put through but you should get it all back dated.

Maybe Charlie if you feel like it a little holiday for some down time. If only they did the job properly at the beginning.

I really do think they need to change this system. If you have an ongoing disease like MS I think it should be scaled for disability EDSS.

ridiculous as non of us are going to get better.

Great to hear you got there in the end but you shouldn’t have to fight for it.
