Offered tue job but then declined due to having MS

I haven’t studied it in depth, and couldn’t find anything specific to the Ambulance Service, but just having a quick Google and a browse round, it would seem that professional drivers (Taxi, HGV, whatever) are required (by law) to have a higher standard of health and fitness than those who only drive for private purposes. Organisations hiring professional drivers not only can subject applicants to a medical, but have to. Obviously, a person with MS cannot meet a higher standard of health than the ordinary, average driver. So they might not have had any choice about whether to offer the job. It could actually be against the law. I would imagine laws relating to passenger (or patient)! safety take higher precedence than those relating to equal opportunities. You cannot put other people at risk, because someone insisted it was “their right” to do a job with impaired health.

Whether the service was at fault in any way for not considering you for a non-driving post instead, I don’t know. But I guess they can only really consider applicants for the post they’ve applied for. If driving is an integral part of the job, they can’t really offer to substitute desk duties for that part of it.

I suppose it is still discrimination - just not necessarily of an illegal kind. Some jobs do, by law, have stringent fitness requirements.

Hi there I am undiagnosed but have been off work a long time and was due to start back at work last week. I was unwell but start back this week, I know I am already in work but basically if I am unable to carry out my normal duties after this phased return then I will no longer have a job as the reality is they need somebody that can fulfil the contract I was set on to do. It’s physically demanding and mentally I am giving it one last shot but have to be honest with my team if I feel I am struggling. I work for the NHS and they have been really good up to press but at the end of the day I have to be realistic in what I can expect of myself. If they say to me hey we don’t think you are up to doing the job then I have to accept that, I’d hate to put myself or others in a compromised position. I hope you get to the bottom of things but feel you may not necessarily be discriminated against by Occy Health, as someone pointed out to me and rightly so Occy Health are on our/your side. They are also clued up about what policies and Acts apply to the work place as that is their job. Maybe speak to Occy Health and ask for an explanation and take things from there. I have found during my meetings with HR and Team Leader they do continually go over my being ill previously before I worked in the department I am in now .I was off work for 18months and they still employed me in the post I am in now knowing my sickness previously . So defo speak to Occy Health xxx good luck xx

Hi Blossom I am wondering if my bosses think they have pooped out employing me, I was in a catch twenty two because I was taken off ESA and put on Job Seekers even though I wasn’t 100 percent well and am back to square one only feeling more ill than before . I applied for Paramedics and you tick on the online application which Class categories you are able to drive. So I agree with you it is odd why accept someone then disallow, although it will have been subject to CRB check, OH, References, etc also you have to do the Ambulance services Maths and English tests, even though I had recently done mine in 2012 with NHS you have to re-do it with ambulance service. So there are lots of hoops to jump through! So they can offer a post but it’s subject to getting all the relevant additional info ticked. :slight_smile: Anon (not the OP anon)
