can they sack me ?

Im going back to work tomorrow after 5 weeks off with a relapse. I have worked for them for 15 years and 2 years ago reduced my hours to just mornings 24 hrs a week. We have access to occupational health but have to be referred by manager. So far my manager hasn’t referred me despite asking him. He’s still doesn’t seem to want to refer me now I last saw o health 4 years ago. Im very confused and feel worried that he’s asked me to into office monday to check whether im able to do my job as Im not office based and work off a rota driving. My worry is can I lose my job if deemed not capable. Or would I be medicaly retired. I have a company pension. Thanks

Hi Yes, you can be dismissed thru incapability, but and this is a very big but, they would have to jump thru a lot of hoops and tick a lot of boxes to get there. They must look at reasonable adjustments and this could include office based work if possible. If you have asked for an OH referral then they should honour this. Medical retirement is an option if it is deemed that no other type of work is managable by you. You sound some distance from this. Regards Neil

surprised you haven’t been referred to Occupational Health - are you sure you have to go through the manager.

What outcome do you want from the meeting?

They can sack anyone. I worked for a company for 10 years and some for 14 years and the company got into trouble. MD told others don’t bother coming back into work no redundancy so after a few months nothing, so those staff went to ACAS and they all was ment to show up on a certain day.

Staff did show up but MD didn’t bother and ACAS said we have no powers we are only amediators so basically useless if a company or owner wants to flout any law if any.

MD knew I had MS and only thing kept my job was he needed me until he ran out of money to pay me.

Hi Anon I have self referred to OH. I suspect they will say you have a disability covered by the equalities act and reasonable adjustments must be considered. your work has to meet with you to discuss reasonable adjustments. If they don’t its discrimination. Good luck Min xx

Thanks all for answering my post. I have spoken with manager who has reorganised my hours, more days off so hopefully this will help. Im still a little concerned about oh but will speak with manager if I feel a need to see them. A friend said to put it in writing next time.

NO they cant sack you. i am having a fazzed return where i do less hrs per day till i can manage my usual hrs… i only work 16 hr. every comp has a HR give them a call an they will work with u and ur …er…not understanding boss to get u back gently. hold ur head up high and dont b bullied there is nothing u can do bout ms and hes/her is guna have to understand that, ther is a MS book that deals with work and relapes, your ms nurse can get 1 for u
