Advice anyone?

Sorry for anon post but looking for some advice. I drive a scooter and was knocked down on a roundabout by a car last week. The accident was not my fault so his insurance should pay. The snag is I never got round to declaring MS to DVLA ( I know that’s stupid but justed never did it) Now all the documents have come through and there is a mandate to access my medical records. I don’t want to claim for compensation as walked away with just a few bruises but do want my bike fixed. Am I screwed?

Pretty much, you could just claim ignorance, say nothing and if the question of your ms is raised inform them you wrote a letter to the DVLA/Insurance company wheneverwayback and you assumed they were aware of your condition. Your Insurance company or the third parties will likely pick up on the diagnosis and it could be a reason to refuse you compensation if they were not aware when you were approved for insurance.

If the DVLA take action against you, you’re in trouble though, ignorance is not a defence in the eyes of the law.

If you’re lucky, nobody will notice, Insurance companies deal with claims every day, you may just get it processed without anybody looking too hard, it’s impossible to know.
