Short story - recently diagnosed - had a period of sickness (in hospital for 2 weeks recieving treatment) from work. During the time I was in hospital, I had previously booked annual leave during this period. Needless to say, I didn’t require the holiday as I was in hospital. A sick note was provided to my employer whilst I was in hospital.
Recently left said employer, however, they have deduced the days I booked as holiday and therefore short paid me. Is this allowed? I clearly wasn’t on holiday and was fully covered by all required sickness notes/letters from Dr’s etc.
I’ve tried researching, but keep finding conflicting information!
Hi Anon, no I don’t think it is allowed. As far as I remember, if you have booked leave and then you are sick during that period, it should be treated as sick leave as long as it is covered by a sick not from your doctor.
If I were you I would write or email HR (or whoever you dealt with when leaving the job) and state clearly that you were covered by a doctor’s sick not therefore you think you should be paid for that period. It may be a simple clerical mistake and they might pay up without a problem.
If they still say you are not entitled to the sick pay ask them to give you that information in writing. Email or letter. Take that to CAB (Citizens Advice Bureau) in you local area. Contact details will be in phone book or online.

Was in hospital due a very bad MS relapse and required treatment and this was clearly stated to my employer. I’m not in a Union, but will def check out the ACAS link - thank you so much.
