Ms and back to work interview

Hi all. Everytime I have a day off sick at work (I’ve had 3 days in the last 1.5yrs) related or not related to ms I have to have a back to work interview and one of the questions on the form is “do you have a disability” my boss always ticks no. Am I right in thinking ms is always classed as a disability and should I tell him that I do have a disability? They’re aware I have ms.

MS itself is not a disability. However, anybody with MS is covered by the Disability Discrimination Act 2005 from the time they are diagnosed. This is because you may become disabled in the future even if you’re not disabled now.

If they know that you have MS but you’re not disabled by it, it’s OK for your manager to tick the NO box.

That makes sense. I just thought I’d check as my company didnt really seem to know what to do when I told them I had ms, and I just wanted to know if they were correct. Thanks for your help

Hi there. I also have a RTW interview if I have any sickness and you should tick yes and if he/she questions why, advise your manager to tick that box as this will help you in case you ever need to ask for reasonable adjustments during your working time. It could be something like splitting your lunch break in two or taking special leave and not annual leave to attend appointments that relate to your MS.
