leaving work

Hi anyone give me some advice, I have been off work now for a yr…I received SSP until August 2012 currently waiting to hear about my Atos Appeal, would I be due any holiday pay etc from my employer? I worked for them for 8yrs.

Unless it says it in your contract, holiday allowances are annual so that any days that haven’t been used are lost at the beginning of the next year. Holiday pay is usually paid pro-rata when someone leaves, e.g. if your allowance was 24 days and you left after 6 months of that year, you would be paid for 12 days (less any holidays you had taken in that time).

There may be extra payment for the fact that you were off sick over bank holidays too, but I’m not sure.

When your company’s year starts will affect how many holidays you are due. (It’s not always January.)

I retired from the local council back in 2000 and i imagine their rules may differ from your employer.

Hi Poll, My employer is a private day nursery, I was kidding myself when I thought I could go back there. Even today I am in agony with my back it feels like it is going to snap.

Yes you will be entitled to payment for A/L which has not been taken from the current leave year - pro rata, of course, as Karen says. Is your employer terminating your employment because of your sickness? If so, they have to pay you a certain amount for each year of your employment with them - if you’ve got Atos involved I’m sure they’ll sort that out for you; but if I can be of any further help feel free to pm me.

Hi carrot cruncher I’m In much the same boat I work for a farmer have been off sick for 8 months nearly he is paying me the holiday that I am entitled to I have worked for him for 15 years but am thinking when do I say enough is enough ? If like u say the employer terminates he has to pay a certain amount for each year I have worked for him does this happen in all cases ??if that’s so I should just wait for him to terminate my employment right ?? Any thoughts gratefully recieved

Hi Coley 2012 - I’m not an expert and every case is different, but there is a correct procedure that the employer should follow. For example there should be dialogue between the employer and employee about what reasonable adjustments could be made to the job and/or the work environment to make it easier for the employee to return to work. I’m really tired at the mo and need my bed! but I will look out some info that I have at work which might be useful and get back to you next week.

Poll, It didnt help at all…I miss my job however I cant do that type of work anymore. : - ( So looks like I will have to retrain, but not sure what to do…saying that thou I get tired so quickly.
